Definitions
- This document shall be referred as Terms and Conditions for Elective Placement Services organised by Vision Synergies, hereafter referred to Terms and Conditions
- “We”, “us” or “our” refers to Vision Synergies
- “You” or “your” refers to client
- “Terms” means Terms and Conditions stipulated in this document
Acceptance of the Terms and Conditions
The services that Vision Synergies provides to you are subject to the following Terms and Conditions. Vision Synergies reserves the right to update the terms at any time without notice to you. The most current version is the one that is published in our website.
The role of Vision Synergies
The role of Vision Synergies is to manufacture agency services related to healthcare elective placements to fit the requirements of our customers. Often we may use reputable independent providers for the provision of selected services, such as accommodation and transport. Sometimes we will own some of the facilities included in the package. Whatever the case, we accept responsibility for the proper performance of your contract with us subject to conditions stipulated hereunder.
Prices
Published prices for the services are based on costs prevailing at the time of publication of this manual. They are subject to change at any time before your booking is made. We reserve the right to increase or decrease published prices at any time before your booking is made. You will be given the correct current price at the time of booking.
Reservations and Payments
A binding contract between you and Vision Synergies comes into existence once your application has been accepted, an offer of the place has been given and a confirmation letter from the hospital has been issued. A preliminary admission does not guarantee you a place until the prescribed payments are cleared. Priority to offering places is given to those who have received preliminary admissions and have cleared their bills.
Amendments and Cancellations by the Client
Amendments or cancellations must be notified to us in writing by email.
- We are supposed to pay the hospital fee and accommodation deposit prior to your admission. In the event of cancellation by you these fees will not be refunded because the hospital does not have a refund policy. The accommodation deposit is non refundable in any case. We will also keep the whole application and organization fee as our cancellation fee. This implies there is no money that will be refunded in case you decide to cancel your programme after the contract is made.
- Amendments include postponing the programme or curtailing the programme. In either case an amendment fee of USD 50 will be charged. In case of postponement the charge must be paid before a guarantee of the place is made for the new time allocation. You will also need to pay USD 100 as the amendment fee of your reserved accommodation. This will be automatically deducted from your accommodation deposit.
- Amendments after your placement has started are entirely at our discretion
- If you curtail your programme after you have started it, we cannot pay any refunds, and you will be responsible for any additional costs involved, including the cost of repatriation.
Amendments and Cancellations by Vision Synergies
- The nature of our programmes is such that details of your placement (such as the department in which you are placed or the type of accommodation) may differ from those originally given to you. We will do our very best to minimise such changes, and to inform you promptly if changes do arise.
- Although it rarely happens and we shall do our utmost to avoid doing so, we must reserve the right to cancel arrangements. In such cases, we will inform you not less than 45 days before your placement start date and refund all fees you have paid to us. This will be the full extent of our liability and we will not accept responsibility for other costs you may incur, such as flight ticket penalties. If we are forced to curtail an offering after departure due to circumstances amounting to force majeure, we regret we cannot make any refunds or pay any compensation or be responsible for any costs or expenses incurred by you as a result.
Force Majeure
‘Force Majeure’ means those circumstances where the performance of our contract with you is prevented or affected by reason of war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions, governmental decisions and action and all similar events beyond our control. In these circumstances, we will not be liable to pay any compensation or otherwise be responsible for any expenses or losses you might incur where we are forced to cancel, delay, curtail or change your arrangements in any way or where the performance or prompt performance of our contractual obligations is prevented or affected.
Complaints
We are here to help you, and our staff will do their very best to provide the highest level of service. The nature of our programmes is also to providing you with an opportunity to gain real life work experience in a working hospital and at your residence. As such you will need to show a high level of independence and initiative, especially in dealing with problems as they arise. If you have any problem that you find difficult to deal with, or which you feel should be our responsibility to resolve, please contact us immediately through email or the telephone number(s) that you will be provided. We regret we cannot accept responsibility for any complaints which are not notified entirely in accordance with this clause.
Insurance
Travelling in underdeveloped areas may inevitably give rise to some risks and dangers including, inter alia, those inherent in travelling by boat, train, road, vehicles, aircraft or other means, the forces of nature, political unrest, accident or illness in remote areas without means of rapid evacuation or medical facilities. This means undertaking our placement carries with it a degree of risk and you must be protected by full travel insurance and (where appropriate) professional indemnity cover.
Visas and Health requirements
- We provide information about visa and health requirements, but we do not accept liability for clients who are inadequately prepared. You are advised to check the local visa entry requirements with the applicable consulate or embassy. Some health requirements may be needed for travellers from some regions or countries. Please seek the advice of your local health authority prior to your departure.
- You are responsible for ensuring that your passport, visa and any other travel documents are valid for the duration of your placement.
- Please note that visas issued for our placements generally do not allow you to undertake any kind of paid work in Zanzibar or other parts of Tanzania. Taking on paid work without the proper permissions may be a serious offence for which you may be prosecuted.
Your Responsibility
- You agree to keep confidential all sensitive information and patient records disclosed to you during your placement.
- Whilst at the hospital hosting your placement you agree to be bound by their rules, regulations and policies.
- For security reasons and to comply with local authority restrictions you are not allowed to invite or allow any person who is not a current Vision Synergies client or staff member to enter your accommodation without the express consent of Vision Synergies or authorised agent of the accommodation.
- We reserve the right to take appropriate action in the event of behaviour which would reasonably be expected to give offence to hosts, project managers, work colleagues or others. This includes behaviour such as serious rowdiness or drunkenness, failure to turn up to work, or leaving work without any adequate reason, or in the event of an unreasonable inability, from whatever cause, to do the work expected.
- A problem that we consider serious would be brought to your attention in writing or, if you were not contactable, delivered to your accommodation address. If the problem still stood after five working days, or shorter period if urgent, a further letter would be sent saying that, if the matter was not resolved to our satisfaction within a further five working days, or shorter period if urgent, you would be removed from the programme and lose all the rights from us. Should you be removed from the programme, we will contact the immigration department stating the termination of our contract. It would be to the discretion of immigration department to depart you from Zanzibar.
Privacy Policy
Information about our clients is used for the intended purpose only, and we are not in the business of selling it to others. The information you provide to us will only be shared with the hospitals you are connected to, and in some cases, the Ministry of Health. Upon request by law enforcing agencies such as Police, Court or Immigration Authorities, Vision Synergies will collaborate with the stated organs, including but not limited to, providing any information requested by them.
Applicable law and place of jurisdiction
These terms and conditions shall be construed, enforced and performed in accordance with the laws of Zanzibar and Tanzania without reference to principles of conflicts of laws. The place of jurisdiction is Zanzibar. You agree that any action at law or in equity that arises out of or relates to these terms will be filed only in the courts of Zanzibar, and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action. Vision Synergies makes no representation that any information, materials or functions included are appropriate for use in any other jurisdiction.
